Welcome to Morning Warrior Coffee (“Morning Warrior Coffee,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your access to and use of MorningWarriorCoffee.com (the “Website”), including all products, services, content, features, and functionality offered through our online store.

By accessing the Website, browsing our content, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Website or purchase our products.

These Terms should be read together with the following policies, which are incorporated into and form part of this agreement:

Morning Warrior Coffee operates as an online retailer. We do not maintain a public retail storefront or offer in-person shopping, local pickup, or walk-in customer service unless expressly stated on the Website.

2. Eligibility

By using the Website, you represent that you are at least the age of majority in your state, province, or country of residence and are legally capable of entering into a binding agreement.

If you permit a minor dependent to use the Website through a device or account you own or control, you accept responsibility for that minor’s activity and compliance with these Terms.

3. Accounts and Customer Information

Certain features may require you to create an account or provide information such as your name, email address, billing address, shipping address, telephone number, and payment information.

You agree to provide information that is accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account.

You may not sell, transfer, assign, or license your account to another person.

4. Products and Product Information

Morning Warrior Coffee sells roasted coffee, coffee-related products, branded merchandise, and other items displayed on the Website.

We make reasonable efforts to provide accurate product descriptions, photographs, pricing, ingredient information, roast details, grind options, weights, and availability. However, product packaging, labeling, colors, or appearance may occasionally vary due to supplier updates, screen settings, manufacturing changes, or product improvements.

Coffee is an agricultural product. Natural differences in growing conditions, roasting, storage, and preparation may result in slight variations in flavor, aroma, color, or appearance between batches. These natural variations do not ordinarily constitute a defect.

We reserve the right to modify, limit, discontinue, or replace products at any time without prior notice.

5. Fresh Roasted-to-Order Fulfillment

Many Morning Warrior Coffee products are roasted or prepared after an order is placed. Orders may be fulfilled and shipped directly by trusted U.S.-based roasting, production, warehousing, or fulfillment partners.

Fulfillment by a third-party partner does not change the fact that your purchase is made from Morning Warrior Coffee. Questions about orders, products, shipping, refunds, or customer service should be directed to us through our Contact Us page.

6. Orders and Acceptance

Placing an order constitutes an offer to purchase. An automated order confirmation does not necessarily mean that your order has been finally accepted.

We reserve the right to refuse, cancel, or limit an order for reasons including:

Product unavailability
Incorrect pricing or product information
Payment authorization problems
Suspected fraud or unauthorized activity
Incorrect or incomplete customer information
Orders intended for unauthorized resale
Legal or regulatory restrictions

If we cancel an order after payment has been successfully processed, we will issue an appropriate refund to the original payment method.

Please review your order carefully before submitting it. Because many products are prepared or roasted to order, we may be unable to cancel or modify an order once fulfillment has begun.

7. Pricing, Taxes, and Promotions

Unless otherwise stated, prices are displayed in U.S. dollars. Prices, discounts, promotions, and availability may change without notice.

The price charged will generally be the price displayed at checkout when the order is placed. Applicable taxes, shipping charges, customs fees, duties, handling fees, or other charges may be added where required.

Promotional offers may have separate terms, expiration dates, exclusions, or eligibility requirements. If promotional terms conflict with these Terms, the specific promotional terms will control for that promotion.

We reserve the right to correct pricing mistakes and cancel orders affected by material pricing or listing errors.

8. Payment

Payments are processed through Shopify and other authorized payment providers made available at checkout.

By submitting payment information, you represent that:

The payment information is accurate and complete
You are authorized to use the selected payment method
The payment provider will honor the charges
You will pay all amounts associated with the order, including applicable taxes and shipping charges

Morning Warrior Coffee does not directly store complete payment card information when payment is processed through third-party payment providers.

9. Shipping and Delivery

Orders are processed and shipped according to our Shipping Policy.

Processing and delivery dates are estimates and are not guaranteed. Delays may result from carrier operations, weather, holidays, customs processing, incorrect address information, supply interruptions, or other circumstances beyond our reasonable control.

Customers are responsible for providing a complete and accurate delivery address. Morning Warrior Coffee is not responsible for delays, losses, or additional charges caused by an incorrect or incomplete address supplied by the customer.

International customers may be responsible for import duties, taxes, customs charges, brokerage fees, or other charges imposed by the destination country.

10. Risk of Loss and Delivery Issues

Risk of loss may pass to the purchaser when the order is transferred to the shipping carrier, to the extent permitted by applicable law.

If an order is damaged, incorrect, lost, or marked delivered but cannot be located, contact us promptly through our Contact Us page.

We may request photographs of the product, packaging, shipping label, or other documentation before approving a replacement, refund, or carrier claim.

11. Returns, Refunds, and Replacements

Returns, refunds, replacements, and exchanges are governed by our Refund Policy.

Coffee and certain other products are consumable, perishable, or prepared to order. For food-safety and quality reasons, we generally cannot accept physical returns of opened coffee or other consumable products.

Do not mail or return products to our business mailing address unless you have received written authorization and return instructions from Morning Warrior Coffee.

12. Subscriptions and Recurring Orders

If subscription products are offered, the price, billing frequency, renewal schedule, cancellation method, and other subscription details will be disclosed before purchase.

By purchasing a subscription, you authorize recurring charges to your selected payment method until the subscription is canceled in accordance with the subscription terms displayed at checkout or in your customer account.

Cancellation generally applies to future billing periods and may not cancel an order that has already entered processing or fulfillment.

13. Coffee, Caffeine, and Health Disclaimer

Products sold through the Website are offered as food and beverage products and are not intended as medical products.

Statements on the Website have not necessarily been evaluated by the U.S. Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease.

Coffee naturally contains caffeine unless specifically identified as decaffeinated. Individual sensitivity to caffeine varies. Consult a qualified healthcare professional before consuming coffee if you are pregnant, nursing, taking medication, sensitive to caffeine, or managing a medical condition.

Customers are responsible for reviewing available product information and determining whether a product is appropriate for their dietary, allergy, or health needs.

14. Intellectual Property

The Website and its content, including the Morning Warrior Coffee name, logos, slogans, product names, text, graphics, photographs, videos, product descriptions, designs, layout, and branding, are owned by or licensed to Morning Warrior Coffee and are protected by applicable copyright, trademark, and other intellectual-property laws.

You may use the Website only for personal, lawful, and non-commercial purposes. Without prior written permission, you may not copy, reproduce, republish, modify, distribute, display, sell, license, scrape, or create derivative works from Website content.

Shopify names, logos, and trademarks belong to Shopify or its licensors. Other third-party names and marks belong to their respective owners.

15. Reviews, Feedback, and User Content

If you submit reviews, photographs, comments, suggestions, testimonials, or other content, you represent that you own or have permission to submit that content and that it does not violate the rights of another person.

You grant Morning Warrior Coffee a worldwide, non-exclusive, royalty-free, transferable, and sublicensable right to use, reproduce, modify, publish, display, and distribute submitted content for operating, improving, and promoting the business, subject to applicable law.

We may remove content that we reasonably believe is unlawful, misleading, defamatory, abusive, obscene, fraudulent, infringing, or otherwise inappropriate.

You may not submit fabricated reviews, conceal compensation connected to a review, impersonate another person, or use a false identity.

16. Prohibited Uses

You may not use the Website or its content:

For an unlawful, fraudulent, or malicious purpose
To violate local, state, federal, provincial, national, or international law
To infringe intellectual-property, privacy, publicity, or other rights
To upload viruses, malware, harmful code, or disruptive technology

18. Relationship with Shopify

Morning Warrior Coffee is powered by Shopify, which provides technology used to operate the online store.

Purchases made through the Website are transactions directly between you and Morning Warrior Coffee. Shopify is not the seller of Morning Warrior Coffee products and is not responsible for product quality, fulfillment, shipping, refunds, customer service, injury, loss, or damage arising from a purchase.

To the extent permitted by law, you release Shopify and its affiliates from claims arising directly from your transaction with Morning Warrior Coffee.

19. Privacy

Personal information collected through the Website is handled according to our Privacy Policy.

Because the Website is hosted on Shopify, information may also be processed by Shopify and service providers that support payment processing, analytics, advertising, shipping, fraud prevention, and store operations.

20. Errors, Inaccuracies, and Omissions

Morning Warrior Coffee does not warrant that the Website will always be uninterrupted, secure, error-free, or free from harmful components. We do not guarantee that all information will always be complete, current, or accurate.

Some jurisdictions do not allow certain warranty disclaimers, so portions of this section may not apply to you.

22. Limitation of Liability

To the fullest extent permitted by applicable law, Morning Warrior Coffee and its owners, affiliates, employees, contractors, agents, licensors, suppliers, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost revenue, lost savings, loss of data, or replacement costs.

Where liability cannot legally be excluded, our total liability arising from an order or use of the Website will not exceed the amount you paid for the product or order giving rise to the claim.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

23. Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Morning Warrior Coffee, Shopify, and their respective affiliates, owners, officers, employees, contractors, agents, licensors, and service providers from claims, losses, liabilities, damages, judgments, and reasonable legal expenses arising from:

24. Termination

Our failure to enforce a provision of these Terms does not waive our right to enforce that provision later.

We may assign or transfer our rights and obligations in connection with a merger, sale, restructuring, service-provider arrangement, or other business transaction, subject to applicable law.

28. Entire Agreement

These Terms, together with the policies linked above and any specific terms displayed during checkout, constitute the entire agreement between you and Morning Warrior Coffee concerning your use of the Website and purchases made through it.

29. Governing Law

These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law rules.

Subject to applicable consumer-protection law, legal proceedings relating to these Terms or purchases from Morning Warrior Coffee will be brought in an appropriate state or federal court located in Connecticut.

We may update these Terms periodically. The current version will be posted on this page with an updated effective date.

Continued use of the Website after revised Terms become effective constitutes acceptance of those revisions, to the extent permitted by law.
